HOUSTON — A deputy who was shot while providing off duty security at a Five Guys in Houston is claiming the restaurant owner's negligence. 

Brian Williams filed a complaint  Oct. 15 in Harris County District Court against BK Shepherd LTD, BK Fairmont LTD, Raetta Building and Development Corporation, Bake Katz Management LLC, Five Guys Enterprises LLC and Five Guys Operations LLC alleging negligence. 

Williams, a deputy with the Harris County Constable Precinct 5, was hired to provide security for the Five Guys restaurant located on North Shepherd Drive in Houston's Greater Heights area, according to his complaint. 

He claims that on Oct. 16, 2019, he jumped out of his patrol car when a person wearing a ski mask began robbing the customers inside the Five Guys. Williams further claims that as he got out of his car, he was shot and suffered injuries to his arm. 

He alleges that prior to the robbery, he told the Five Guys managers that he "was a sitting duck" inside the restaurant since he could not see into the dark parking lot and that he would have to observe the restaurant from his patrol car in the parking lot. 

He also alleges that Five Guys was aware the area was dangerous and full of criminal activity at night but failed to have adequate security measures in place on its premises despite his warnings. 

Williams seeks monetary relief of more than $1 million, interest and all other just relief.
